When A Child's Voice Needs To Be Heard In Court, Attorney Daniel DeSario Is Dedicated To Protecting Their Best Interests

Custody disputes can be overwhelming—not just for parents, but especially for children. When concerns arise about a child’s well-being, the Court may appoint Minor’s Counsel to help ensure their needs are properly heard and protected. When Mr. DeSario is appointed as Minor’s Counsel, he takes the time to understand what the child is experiencing and works to ensure their needs remain at the center of the case. He knows that custody disputes can be overwhelming for families, and that children often need a steady, independent voice during these moments. His role is to provide that voice—calmly, thoughtfully, and with care.

Mr. DeSario takes a thorough and thoughtful approach to each appointment. He may meet with the child, speak with both parents, review court records, and communicate with teachers, caregivers, and other professionals involved in the child’s life. When appropriate, he also reviews educational, medical, and mental health information to develop a clear understanding of what will best support the child’s well-being. Where appropriate, he will share the child’s wishes with the Court and advise if the child would like to speak directly with the judge—always in a way that protects the child from unnecessary stress or being placed in the middle of conflict.

With more than four decades of experience in family law, Mr. DeSario brings a steady, balanced approach to even the most difficult cases. He understands that these matters are deeply personal, and he works to provide the Court with clear, objective insight while helping families move toward more stable and workable outcomes for their children. His experience includes high-conflict custody matters, cases involving children with special needs, and matters involving the Los Angeles County Department of Children and Family Services.

"Having worked almost exclusively in family law for over 40 years, I see a need for being proactive in talking to children face to face. The little ones I sit down at eye level, in a setting where they are comfortable to talk about there wants, needs, how they're being treated by each parent. The need does not change as they get older. I want to make sure they are heard. As a number of judges who I have immense respect for these kids, tweens, teens, or even the little ones need to know they have a voice and in many instances a vote. When I advocate for them, I want to have had a personal interaction with them so I can present their best interests to the court with my reasoning so both parents understand. The Judge has the final decision I just want to make sure they have all the facts."
